Please read these Terms of Service carefully. They form a legally binding agreement between you and Elfinic Commerce Pvt Ltd governing your access to and use of the Acromart marketplace at www.acromarts.com and its related applications and services. By using Acromart, you confirm that you have read, understood, and agree to be bound by these Terms.
1. Introduction & Acceptance
“Acromart” is a building materials marketplace operating under the tagline Build Beyond Ordinary, owned and operated by Elfinic Commerce Private Limited (CIN U47190MH2025PTC459437), with its registered office in Vashi, Navi Mumbai, Maharashtra, India.
These Terms govern your access to and use of the Acromart website, mobile applications, vendor hub and all associated features, content and services (the “Platform”). By accessing, browsing, registering on or transacting through the Platform, you agree to be bound by these Terms and by all policies referenced herein. If you do not agree, you must not access or use the Platform.
Your use of the Platform is also governed by our Privacy Policy, Returns & Refund Policy, Shipping & Delivery Policy, and — for vendors — the Vendor Agreement, each incorporated by reference. This document is an electronic record under the Information Technology Act, 2000.
2. Definitions
- Platform: The Acromart website, mobile/web applications, vendor hub and related digital services.
- Marketplace: The online facility enabling third-party Vendors to list and sell Products to Buyers.
- Buyer: Any User who purchases Products through the Platform (B2C or B2B).
- Vendor / Seller: Any third-party business or individual registered on the Platform to list and sell Products.
- Products: Building materials, construction supplies, hardware, fittings, tools and related goods listed on the Marketplace.
- Intermediary: The Company in its role under Section 2(1)(w) of the IT Act, 2000, facilitating transactions between Buyers and Vendors.
3. The Marketplace Model & Our Role
Acromart operates as a marketplace e-commerce entity within the Consumer Protection (E-Commerce) Rules, 2020. Unless a Product is marked as “Sold by Acromart”, the contract of sale is formed directly and exclusively between the Buyer and the Vendor. The Company is not the seller, manufacturer, importer or supplier of Vendor-listed Products and acts only as a facilitating intermediary.
4. Eligibility
- You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872;
- If registering for a business, you must be duly authorised to bind that entity;
- You must not be barred from receiving services under applicable law;
- You must provide valid statutory registrations (such as GSTIN) where required.
5. Account Registration & Security
Certain features require you to register. You agree to provide accurate, current and complete information, keep it updated, maintain the confidentiality of your credentials, and accept responsibility for all activity under your account. Notify us of any unauthorised use.
6. Buyer Terms
Buyers may browse, place orders and pay through the Platform subject to these Terms. Given the nature of building materials, you (or your authorised representative) are responsible for inspecting Products at the time of delivery. Any visible damage, shortage, breakage or discrepancy must be recorded and reported within the timelines specified in our Returns & Refund Policy, failing which claims may not be entertained.
7. Vendor & Seller Terms
Vendors are subject to these Terms and to the separate Vendor Agreement, which governs commercial terms, commissions, fees, payouts and operational obligations. In the event of conflict, the Vendor Agreement prevails for Vendor-specific matters.
8. Product Listings & Information
Product information is primarily provided by Vendors. While the Company endeavours to display this information correctly, it does not warrant that such information is error-free, complete or current.
Natural materials & variance. Many building materials — including stone, tiles, marble, wood, bricks and aggregates — may exhibit natural variations in colour, shade, texture, grain, finish and dimensions between the images displayed and the Product delivered, and between batches. Such variation is inherent to the material and does not, by itself, constitute a defect.
9. Pricing, Taxes & GST
Prices are set by Vendors (or the Company for own inventory) and are inclusive or exclusive of taxes as indicated. Applicable GST and other taxes will be charged in accordance with law. Tax invoices will be issued by the seller of record.
10. Orders & Contract Formation
When you place an Order, you make an offer to purchase the selected Products subject to these Terms. An Order acknowledgement confirms receipt of your offer but does not, by itself, constitute acceptance. Acceptance occurs when the seller dispatches the Product or as otherwise stated.
11. Payments
Payments are processed through PCI-DSS-compliant gateways. The Company does not store complete card details. You authorise us and our partners to process payments as required to complete your transaction.
12. Shipping, Delivery & Logistics
- Estimates only: Delivery timelines are estimates, not guarantees;
- Site access: You must ensure safe, lawful and adequate vehicular access. Where this is not possible, materials may be delivered to the nearest accessible point;
- Unloading: Unless expressly included, unloading and on-site placement are the Buyer’s responsibility.

13. Cancellation, Returns & Refunds
Cancellations, returns and refunds are governed by our Returns & Refund Policy. Made-to-order, cut-to-size, custom-mixed or specially procured Products, and time-/moisture-sensitive materials once delivered, are generally not returnable except where defective or incorrectly supplied.
14. Bulk, Project Orders & Quotations
Bulk and project orders may be governed by separate quotations and terms in addition to these Terms. Where there is a conflict for a specific order, the quotation prevails for that order.
15. Reviews & User Content
You represent that your Content is accurate, lawful and your own, and that it does not infringe any third party’s rights. You must not post Content that is false, misleading, defamatory, obscene, abusive, infringing or otherwise unlawful. The Company may, but is not obliged to, review, moderate, edit or remove Content.
16. Intellectual Property
The Platform — including its design, layout, software, graphics, the “Acromart” name, logos and marks — is owned by or licensed to the Company and protected by applicable law. You may not use any of these without our prior written consent.
17. Prohibited Activities
- Use the Platform for unlawful purposes or to harm others;
- Upload viruses, malware or harmful code;
- Scrape, crawl or copy content without permission;
- Interfere with, disrupt or place undue load on the Platform;
- Impersonate any person, manipulate prices, post fake reviews or circumvent fees.
18. Third-Party Links & Services
The Platform may contain links to third-party websites and services. We are not responsible for their content, policies or practices.
19. Disclaimers & Warranties
The Platform and Vendor-listed Products are provided on an “as is” and “as available” basis, without warranties of any kind to the extent permitted by law. Manufacturer or vendor warranties, where applicable, apply on their own terms.
20. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special or consequential damages, or for acts, omissions or defaults of Vendors, third-party logistics providers or payment gateways. Nothing in these Terms limits liability that cannot be limited under applicable law.
21. Indemnification
You agree to indemnify, defend and hold harmless the Company, its directors, officers, employees and agents from all claims arising out of your use of the Platform, your Content, your breach of these Terms or violation of any law or third-party right.
22. Privacy & Data Protection
Your personal data is processed in accordance with our Privacy Policy.
23. Grievance Redressal
We have appointed a Grievance Officer to address user complaints in accordance with the IT Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020 — see contact details below.
24. Suspension & Termination
We may suspend or terminate your access to the Platform for breach of these Terms, fraud, legal risk or repeated policy violations, with or without notice as appropriate.
25. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Subject to §26, the courts at Navi Mumbai / Mumbai, Maharashtra, India shall have exclusive jurisdiction.
26. Dispute Resolution & Arbitration
Parties shall first attempt to resolve disputes amicably through the grievance mechanism in §23. Failing resolution within thirty (30) days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with seat and venue at Navi Mumbai, Maharashtra, and proceedings in English.
27. Force Majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control, including natural disasters, weather, strikes, transport disruptions or government action.
28. Changes to These Terms
We may amend these Terms from time to time. Updated Terms will be posted on the Platform with a revised effective date. Continued use after such changes constitutes acceptance.
29. General Provisions
- Severability: Invalid provisions are severed; the rest remains in effect.
- Waiver: No delay or failure to enforce is a waiver.
- Assignment: You may not assign without our consent.
- Entire agreement: These Terms and referenced policies constitute the entire agreement.

For questions, requests or complaints, contact our Grievance Officer. We will acknowledge complaints within forty-eight (48) hours and endeavour to resolve them within one (1) month, in line with applicable law.
